1、CONTRACTISSUED AND PRINTED BYTHE STATE ADMINISTRATION OF FOREIGNEXPERTS AFFAIRS（Copies Are Invalid）CONTRACT.Party A wishes to engage the service of Party B as . The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations

4、ons.4.Party A shall provide co-workers.5.Party A shall pay Party Bs salary regularly by the month.Party Bs Obligations1.Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in Chinas internal affairs.2.Party B shall observe Party

5、As work system and regulations concerning administration of foreign experts and shall accept Party As arrangement, direction, supervision and evaluation in regard to his/her work. Without Party As consent, Party B shall not render service elsewhere or hold concurrently and post unrelated to the work

6、 agreed on with Party A.3.Party B shall complete the tasks agreed on on schedule and guarantee the quality of work.4.Party B shall respect Chinas religious policy, and shall not conduct religious activities incompatible with status of an expert.5.Party B shall respect the Chinese peoples moral stand

7、ards and customs.Revision, Cancellation and Termination of the Contract1.Both Parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.2. The contract can be revised, canceled, or terminated with mutual consent. Before both

8、Parties have reached and agreement, the contract should be strictly observed.3.Party A has the right to cancel the contract with a written notice to Party B under the following conditions:(1)Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms sti

9、pulated, and has failed to amend after Party A has pointed it out.(2)According to the doctors diagnosis, Party B cannot resume normal work after a continued 30 days sick leave.4.Party B has the right to cancel the contract with a written notice to Party A under the following conditions:(1)Party A ha

10、s not provided Party B with necessary working and living conditions as stipulated in the contract.(2)Party A has not paid Party B as scheduled.Breach PenaltyWhen either of the two parties fails to fulfill the contract or fails to fulfil the contract obligations according to the terms stipulated, tha

11、t is, breaks the contract, it must pay a breach penalty of US500 to 2,000(or the equivalent in RMB).If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party Bs return expenses; if Party A cancels the contract valid reason, it should pay Pa

12、rty Bs return expenses and pay a breach penalty to Party B.The appendix of this contract is and inseparable part of the contract has equal effect.This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. 16、、法規(guī)和聘方有關(guān)工作制度以及有關(guān)外國(guó)專家的管理規(guī)定。2、 對(duì)受聘方的工作進(jìn)行指導(dǎo)、檢查和評(píng)估。3、 向受聘方提供必要的工作和生活條件。4、 配備合作共事人員。5、 按時(shí)支付受聘方的報(bào)酬。六、受聘方的義務(wù)：1、 遵守中國(guó)的法律、法規(guī)，不干預(yù)中國(guó)的內(nèi)部事務(wù)。2、 遵守聘方的工作制度和有關(guān)外國(guó)專家的管理規(guī)定，接受聘方的工作安排、業(yè)務(wù)指導(dǎo)、檢查和評(píng)估。未經(jīng)聘方同意，不得兼任與聘方無關(guān)的其他勞務(wù)。3、 按期完成工作任務(wù)，保證工作質(zhì)量。4、 尊重中國(guó)的宗教政策。不從事與專家身份不符的活動(dòng)。5、 尊重中國(guó)人民的道德規(guī)范和民俗習(xí)慣。七、合同的變更、解除和終止：1、 雙方應(yīng)信守合同，未經(jīng)雙方一致同意，任何一方不

17、得擅自更改、解除和終止合同。2、 經(jīng)當(dāng)事人雙方協(xié)商同意后，可以變更、解除和終止合同。在未達(dá)成一致意見前，仍應(yīng)當(dāng)嚴(yán)格履行合同。3、 聘方在下述條件下，有權(quán)以書面形式通知受聘方解除合同：（1） 受聘方不履行合同或者履行合同義務(wù)不符合約定條件，經(jīng)聘方指出后，仍不改正的；（2） 根據(jù)醫(yī)生診斷，受聘方在病假連續(xù)30天后不能恢復(fù)正常工作的。4、 受聘方在下述情況下，有權(quán)以書面形式通知聘方解除合同：（1） 聘方未按合同約定提供受聘方必要的工作和生活條件；（2） 聘方未按時(shí)支付受聘方報(bào)酬。八、違約金：當(dāng)事人一方不履行合同或者履行合同義務(wù)不符合約定條件，即違反合同時(shí)，應(yīng)當(dāng)向另一方支付5002000美元（或相當(dāng)數(shù)

18、額的人民幣）的違約金。受聘方因不可抗力事件要求解除合同，需出具有關(guān)機(jī)構(gòu)證明，經(jīng)聘方同意后，離華費(fèi)用自理外，還應(yīng)當(dāng)向聘方支付違約金。聘方因不抗力事件要求解除合同，經(jīng)受聘方同意后，離華費(fèi)用由聘方擔(dān)負(fù)；聘方若無故解除合同，除負(fù)擔(dān)受聘方離華費(fèi)用外，還應(yīng)當(dāng)向受聘方支付違約金。九、本合同附件為合同不可分割的一部分，與合同具有同等效力。十、本合同自雙方簽字之日起生效，合同期滿即自行失效。當(dāng)事人一方要求簽訂新合同，必須在本合同期滿90天前向另一方提出，經(jīng)雙方協(xié)商同意后簽訂新合同。受聘方合同期滿后，在華逗留期間的一切費(fèi)用自理。十一、仲裁當(dāng)事人雙方發(fā)生合同糾紛時(shí)，盡可能通過協(xié)商或者調(diào)解解決。若協(xié)商、調(diào)解無效，可向國(guó)家外國(guó)專家局設(shè)立的外國(guó)文教專家事務(wù)仲裁機(jī)構(gòu)申請(qǐng)仲裁。本合同于 年 月 日在 （地點(diǎn)）簽訂，一式兩份，每份都用中文和 文寫成，兩種文本同等作準(zhǔn)。聘方 受聘方
