11、ustralian legal system will be examined by analyzing, describing and researching its structure, creation and interpretation. Understanding law, legal system is the precondition for understanding all the topics in this subject. So the first topic is of the most important one for the student to gra

12、sp. For Chinese students with no law background, it is more difficult to understand the common law system. So how to make the content of this part easy to understand is vital. Topic 2 Crime is a concept different from the other offences. What is crime, the aim of the criminal law and the proces

13、s of the criminal trial is the starting point in this topic. After the students having a rough understanding on those issues, then the white-collar crime is the key issue of this topic, which is also the difficulty part in this topic. Topic 3 In this topic, both real property and personal prope

14、rty are discussed. The meaning of property, real property and personal property should be fully understood. Then the law on the land, including the ownership of land, the legal and equitable interests in land, the Torrens title and general law, will be presented. Then the law on intellectual pro

15、perty is examined, which contains the law on copyright, designs, patents, and trademarks Topic 4 Tort in the business world is another important issue in business law area. This part examines the definition of tort, the difference of tort with other crime, negligence and the damages of tort, a

16、s well as negligent statement. Tort is an abstract concept to understand, and there are many relevant concepts which are hard to understand, such as negligence, duty of care, reasonable man, etc. Only with fully understanding of those concepts can the students know the tort in the business world

17、 and the relevant laws on it. Topic 5 Contract is one of the most important parts in business area. The regulation on contract also differs greatly. This topic is also the most important topic for this subject. The formation of contract and the enforcement of contract are the two main parts. Mo

18、re time will be attributed to this part due to the significance of contract. The contract law under common law system differs a lot from our country, there are also some abstract concept for the students to understand, such as consideration. Topic 6 Sale of goods law, one of the important parts

19、of business law, is put in this topic. The legal requirements of the Sale of Goods Acts and the parallel provisions in the Australian Consumer Law are introduced at the beginning. Then the overlapping remedies against manufacturers for defective or unsafe goods or serviced (the product liability

20、 laws) are analyzed. The general consumer protection and the specific consumer protection in the Australian Consumer Law are discussed. Topic 7 In this part, the dispute resolutions in business area will be introduced, which include litigation, arbitration and ADRs. The characteristics of each p

21、art, as well as the advantages and disadvantages of each way will be analyzed.
