professional ethics carry out rules of safe operation improve professional skills and accomplishes production tasks 1 2 甲方可根據(jù)生產(chǎn)經(jīng)營(yíng)需要依法調(diào)整乙方的工作崗位或職位 Party A may legitimately adjust Party B s post according to business requirements 二 合同期限 Article Two Term of Contract 本合同自 年 月 日至 年 月 日 其中試用期為 個(gè)月 自 年 月 日 至 年 月 日 勞動(dòng)合同的期限屆滿或約定的終止條件出現(xiàn) 勞動(dòng)合同即終止執(zhí)行 is willing to do so 3 3 甲方由于工作需要更改工時(shí)制度 經(jīng)政府有關(guān)部門批準(zhǔn)后 乙方應(yīng)密切配合執(zhí)行 Party A may change working hours system for business requirement after approval by relevant government authorities and Party B shall execute it of his own will 四 薪酬 Article Four Remuneration 4 1 甲方支付乙方的每月基本工資為人民幣 元 上述薪酬不包括甲方按公司補(bǔ)貼規(guī)定按月向乙方支 付的所有補(bǔ)貼 可編輯修改 Party A pays RMB to Party B as basic implement relevant regulations and standard per the lowest wage 4 3 甲方的發(fā)薪日期為每月 日 Party A shall pay the wage on the day every month 五 勞動(dòng)保護(hù)與勞動(dòng)條件 Article Five Labor Protection and Labor Conditions 5 1 甲方須對(duì)乙方進(jìn)行勞動(dòng)安全 業(yè)務(wù)技術(shù)及勞動(dòng)紀(jì)律等方面的教育和培訓(xùn) 并根據(jù)國家對(duì)勞動(dòng)保護(hù) 安全生 產(chǎn)的要求 為乙方提供必要的生產(chǎn) 工作 條件 保障乙方的安全健康 Party A shall give Party B education and training programs relating to labor safety professional skills and labor disciplines etc According to the requirements of state labor protection and safe production Party A shall provide necessary working condition to ensure Party B s safety and health 六 社會(huì)保險(xiǎn)和福利 Article Six Social Insurance and Welfare 6 1 甲方依法替乙方辦理各項(xiàng)社會(huì)保險(xiǎn)并繳納保險(xiǎn)費(fèi)用 但依法規(guī)定之分?jǐn)偙壤?屬于乙方須自行負(fù)擔(dān)之各項(xiàng) 社會(huì)保險(xiǎn)金 由甲方于每月發(fā)薪時(shí) 從乙方薪資中代扣代繳 Party A shall transact social insurance and pay them for Party B Party A shall withhold the social security contribution legally undertook by Party B when paying the remuneration every month 6 2 乙方享有國家規(guī)定的所有法定假日 Party B will take all statutory holidays stipulated by the State 6 3 甲方實(shí)行年休假制度 乙方連續(xù)工作滿一年以上的可享受有薪年假 申請(qǐng)享受辦法按公司甲方制定的年假 規(guī)定執(zhí)行 Party A carries out annual vocation system Party B can take paid annual vocation after continuously working for 1 year and the applying procedure for annual vocation shall be done pursuant to Party A s stipulation 七 乙方責(zé)任 Article Seven Party B s Responsibility 7 1 乙方必須認(rèn)真工作和勞動(dòng) 保質(zhì)保量地完成自己的生產(chǎn)任務(wù) Party B must work earnestly and accomplish its own tasks with quality and quantity 7 2 乙方必須如實(shí)匯報(bào)工作 積極配合和協(xié)助上級(jí)的工作 Party B must report its job according to the facts and shall cooperate with its uppers and assist their jobs 7 3 乙方應(yīng)嚴(yán)格履行甲方依法制定的規(guī)章制度和 員工手冊(cè) Party B shall strictly implement the rules and regulations and Handbook legally stipulated by Party A 7 4 乙方應(yīng)愛護(hù)甲方的財(cái)物 對(duì)由于本人責(zé)任造成的直接經(jīng)濟(jì)損失 必須予以賠償并接受甲方的處罰 Party B shall take good care of Party A s property and he she must indemnify direct damage due to his her liability and accepts Party A s punishment 7 5 乙方在勞動(dòng)合同有效期內(nèi)未經(jīng)甲方事先書面同意 不得為另一家雇主工作 Party B can not work for another employer without Party A s written consent in the duration of Labor Contract 7 6 乙方應(yīng)嚴(yán)格保守甲方的商業(yè)秘密 不得向任何第三方泄露 Party B shall strictly keep Party A s trade secret and can not divulge to any third party 7 7 如實(shí)陳述履歷和學(xué)歷 Party B shall state his her curriculum vitae and educational background according to the facts 7 8 如甲方委派乙方培訓(xùn) 包括海外培訓(xùn) 乙方必須遵守甲方的培訓(xùn)條規(guī)和承諾 可編輯修改 Party B shall observe Party A s training rules and undertaking when Party A assigns Party B to be trained 八 甲方無償解除合同 Article Eight Cancellation of the Contract without Compensation by Party A 若符合下列情況之一的 甲方可以隨時(shí)解除合同 而不必給予乙方任何經(jīng)濟(jì)補(bǔ)償 Party A may cancel the Contract at any time without compensation to Party B under the following circumstances 8 1 當(dāng)乙方在試用期內(nèi)不符合甲方的職工錄用條件 甲方無須給予乙方解除的原因 When Party B is proven to be unqualified for Party A s employment conditions during probation period Party A need not give Party B the reason for cancellation 8 2 乙方嚴(yán)重違反甲方依法制定的規(guī)章制度和勞動(dòng)紀(jì)律 Party B seriously violates rules and regulations labor discipline legally stipulated by Party A 8 3 乙方嚴(yán)重失職 營(yíng)私舞弊 給甲方利益造成重大損失 Party B seriously neglects his her duty and grafts resulting in Party A s great loss 8 4 乙方違反中國法律 受到司法處罰或追究刑事責(zé)任 Party B violates the laws of PRC and gains judicial punishment or is found a guilty 九 甲方有償解除合同 Article Night Cancellation of the Contract with Compensation by Party A 有下列情形之一的 甲方可以解除勞動(dòng)合同 但是應(yīng)當(dāng)提前 30 天以書面形式通知乙方或支付一個(gè)月基本 工資代替 并依法支付乙方經(jīng)濟(jì)補(bǔ)償金或補(bǔ)助費(fèi) Under the following circumstances Party A may cancel the Contract with 30 days prior written notice to Party B or paying one month basic wage instead and legally pay economic compensation or subsidy to Party B 9 1 乙方患病或非因工受傷 醫(yī)療期滿后仍不能從事原工作或由甲方另行安排的工作的 Party B is ill or non work related injured and unable to do the former job or other job assigned by Party A after medical treatment 9 2 乙方不能勝任工作 經(jīng)過培訓(xùn)或調(diào)整工作崗位 仍不能勝任的 Party B is not competent for the job and still remains so after training or adjustment of the post 9 3 本合同訂立時(shí)所依據(jù)的客觀情況發(fā)生重大變化 致使本合同無法履行 甲乙雙方不能就變更本合同達(dá)成協(xié) 議的 The basis for the conclusion of the contract has greatly changed so that the contract can no longer be carried out while both parties can not reach an agreement on modifying the contract by mutual negotiation 9 4 甲方瀕臨破產(chǎn) 進(jìn)入法定整頓期間或者生產(chǎn)經(jīng)營(yíng)狀況發(fā)生嚴(yán)重困難 達(dá)到當(dāng)?shù)厝嗣裾?guī)定的嚴(yán)重困難企 業(yè)標(biāo)準(zhǔn) 確須裁減人員 并按法定程序解除勞動(dòng)合同的 Party A is close to bankruptcy and enters into legal rectification period or it is in a severe difficulty to meet the standard of severe difficult enterprise stipulated by the local government and the retrenchment is needed and then Party A cancels the contract according to legal procedure 十 乙方要求解除合同 Article Ten Cancellation of the Contract at Party B s request 10 1 乙方要求解除勞動(dòng)合同 應(yīng)當(dāng)提前三十天以書面形式通知甲方 但必須依照 11 2 條款賠償甲方 Party B shall give 30days prior written notice to Party A when requesting to cancel the Contract but he she shall indemnify Party A according to Article 11 2 10 2 乙方在下列情況下 可隨時(shí)通知甲方解除勞動(dòng)合同 Under the following circumstances Party B may inform Party A to terminate the Contract at any time a 在試用期內(nèi) 可編輯修改 Be in probation period b 甲方不按照勞動(dòng)合同支付勞動(dòng)報(bào)酬或者提供勞動(dòng)條件的 Party A didn t pay the remuneration or provide working conditions according to the Contact c 甲方以暴力威脅或者非法限制人身自由的方法強(qiáng)迫乙方工作的 Party A forces Party B to work by means of force threat or illegal restriction of personal freedom 十一 違約責(zé)任 Article Eleven Liability for Breach of Contract 11 1 甲方依第 9 條提前解除合同 應(yīng)按法律規(guī)定向乙方支付經(jīng)濟(jì)補(bǔ)償金 Party A shall legally pay economic compensation to Party B when canceling the Contract pursuant to Article Night 11 2 乙方違約不履行合同 應(yīng)按 培訓(xùn)合同 的約定及法律法規(guī)的規(guī)定賠償甲方的經(jīng)濟(jì)損失 Party B shall indemnify Party A for its economic loss according to laws and regulations and Training Agreement when he she breaches the Contract 十二 合同附件 Article Twelve Annexes of the Contract 12 1 本合同的附件為本合同不可分割的組成部分 與本合同具有相等的法律效力 The Annexes are indivisible parts of this contract and they have the same effect as this contract 12 2 甲方依法制定的 員工手冊(cè) 及各項(xiàng)規(guī)章制度是本合同的附件 Handbook and other rules and regulations legally stipulated by Party A are annexes of this Contract 十三 勞動(dòng)爭(zhēng)議 Article Thirteen Labor Dispute 甲乙雙方若發(fā)生勞動(dòng)爭(zhēng)議 應(yīng)通過友好協(xié)商解決 若不能解決 可以向當(dāng)?shù)赜泄茌牂?quán)的勞動(dòng)爭(zhēng)議仲裁委員 會(huì)申請(qǐng)仲裁 對(duì)仲裁不服的 可向人民法院起訴 提出仲裁的一方應(yīng)當(dāng)在勞動(dòng)爭(zhēng)議發(fā)生之日起 60 天內(nèi)向 勞動(dòng)爭(zhēng)議仲裁委員會(huì)提出書面申請(qǐng) 當(dāng)事人對(duì)仲裁裁決不服的 可以在收到仲裁裁決書之日起 15 天內(nèi)向 人民法院起訴 If labor dispute occurs both parties shall resolve it through consultation In case of failing to reach an agreement each party may submit the dispute to Labor Dispute Arbitration Committee having jurisdiction If rejecting the award each party can take a proceeding The party applying for arbitration shall submit the arbitration application to Labor Dispute Arbitration Committee within 60 days when the labor dispute arises If rejecting the award the party can sue to the court within 15 days after receipt of the award 十四 合同生效 Article Fourteen Effectiveness of the Contract 本合同自甲 乙雙方簽訂后生效 并呈送有關(guān)鑒證單位鑒證 This contract is effective by signatures of both parties and shall be submitted to the surveyor 十五 其它 Article Fifteen Miscellaneous 15 1 本合同未盡事宜 可由甲 乙雙方另行訂立補(bǔ)充條款 補(bǔ)充條款與本合同具有相同的法律效力 If there is something unclear both parties may conclude a supplement clause and the clause shall have the same effect as this contract 15 2 在合同履行中 發(fā)生其他事項(xiàng)而本合同未明確的 按國家和地方有關(guān)法規(guī)執(zhí)行 有關(guān)條款如國家和地方有 新的法規(guī)規(guī)定 按新的規(guī)定執(zhí)行 If there is something undefined in
